Types of Adoption Available

A second-parent adoption allows the unmarried partner of someone who is the biological or adoptive parent of a child to adopt that child. This is done without the legal parent being made to lose his or her lawful parental rights. 

Stepparent adoptions are also available to same-sex couples who have married. The marriage allows the non-biological or adoptive spouse to legally adopt his or her spouse’s child. 

Co-parent adoptions are essentially second-parent adoptions in which you can adopt your partner’s biological or adopted child even though you are unrelated to the child by blood or law. Co-parent and second-parent adoptions generally occur when one of the partners brings children from prior relationships into the current relationship or when the partners have used assisted reproductive technology to create a pregnancy.

Adoption law in Alabama states that “any adult person or husband and wife jointly who are adults may petition the court to adopt a minor.” This statement does not explicitly bar same-sex couples or LGBTQ individuals from the process of adoption.
